Terms and Conditions

By using our services, website, or patient portal, you agree to the following Terms and Conditions.

1. Scope of Services

  • Our clinic provides pediatric healthcare to infants, children, and adolescents.

  • Services may include preventive care, sick visits, vaccinations, diagnostic testing, laboratory services, telehealth, and referrals.

  • All care is provided by licensed healthcare professionals under California law.

2. Patient Eligibility

  • Patients must be accompanied by a parent or legal guardian unless legally permitted to consent on their own (see Section 6: Patient Rights).

  • Parents/guardians are responsible for providing accurate demographic, medical, and insurance information.

3. Appointments & Cancellations

  • Appointments are required for most visits. Same-day visits may be available on a first come first serve basis or urgent needs.

  • Please provide 24 hours’ notice for cancellations. Missed appointments may result in a fee.

  • Repeated no-shows or late cancellations may affect future scheduling.

4. Telehealth Services (California Law)

  • Telehealth is available when medically appropriate.

  • Under California Business & Professions Code § 2290.5, informed consent is required before starting a telehealth visit.

  • Patients may refuse telehealth and request in-person care.

  • Telehealth is conducted over secure, HIPAA-compliant platforms.

5. Billing & Insurance

  • Parents/guardians are financially responsible for all charges, including amounts not covered by insurance.

  • Co-pays, deductibles, and balances are due at the time of service.

  • We accept most major California insurance plans. Verification is required at each visit.

  • Uninsured patients may request cash-pay rates or payment arrangements, as allowed by law.

6. Patient & Minor Rights in California

At Atlantic Pediatric, we respect the legal rights of pediatric patients and their families under California and federal law:

  1. General Patient Rights

    • To be treated with respect, dignity, and privacy.

    • To receive care regardless of race, ethnicity, religion, gender, sexual orientation, or disability.

    • To access your child’s medical records, except where restricted by law.

    • To request corrections to medical records.

    • To consent to or refuse medical treatment (if the patient is legally permitted to consent).

  2. Parental Rights

    • Parents/legal guardians generally have the right to make healthcare decisions for their children.

    • Parents/guardians will be informed about diagnosis, treatment options, and care plans except when minors legally consent to certain services on their own.

  3. Minor Consent Rights (California Family Code §§ 6920–6929)

    • California law allows minors to consent to certain healthcare services without parental involvement, including:

      • Age 12+: Outpatient mental health treatment or counseling (if deemed mature enough).

      • Age 12+: Services related to sexual and reproductive health (e.g., contraception, pregnancy, STD testing/treatment).

      • Age 12+: Substance use disorder treatment.

      • Any Age: Emergency care when delay would endanger health or life.

    • In these cases, minors control access to their medical information, and parents/guardians may not have access to those records without the minor’s consent.

  4. Privacy & Confidentiality

    • We comply with HIPAA and the California Confidentiality of Medical Information Act (CMIA).

    • Patient information is only shared with authorized parties or as required by law.

7. Website & Patient Portal Use

  • The patient portal allows for secure communication, test results, scheduling, and billing.

  • It is not for emergencies. Call 911 in life-threatening situations.

  • Unauthorized use of the portal or website is prohibited.

8. Emergencies

  • Our clinic is not an emergency care facility.

  • For urgent or life-threatening emergencies, call 911 or visit the nearest emergency department.

9. Code of Conduct

  • Respectful communication and behavior are required from patients, guardians, and staff.

  • Threats, abuse, or discrimination may result in dismissal from the practice in compliance with California law.

10. Changes to Terms

  • We may update these Terms & Conditions at any time. Updates will be posted in our office and on our website.

  • Continued use of services constitutes acceptance of updates.

11. Governing Law

  • These Terms & Conditions are governed by the laws of the State of California.

  • Any disputes will be resolved under California jurisdiction.
